เงื่อนไขฉบับนี้เป็นข้อตกลงระหว่าง บริษัท พัชชาทราเวล จำกัด (สำนักงานใหญ่) เลขทะเบียนนิติบุคคล 0-1355-65018-18-7 (“ผู้ให้บริการ”) กับบริษัทหรือบุคคลที่สมัครใช้บริการ TourAccount (“ผู้ใช้บริการ”) การสมัครใช้งานหรือใช้งานระบบถือว่าผู้ใช้บริการยอมรับเงื่อนไขฉบับนี้
1. บริการ
TourAccount เป็นซอฟต์แวร์บัญชีคู่สำหรับธุรกิจนำเที่ยว ให้บริการในรูปแบบสมัครสมาชิกรายเดือน/รายปี (Software as a Service) ครอบคลุมการออกเอกสารขาย การบันทึกบัญชี การจัดการต้นทุนทริป และฟังก์ชันที่เกี่ยวข้องตามแพ็กเกจที่ผู้ใช้บริการเลือก
2. การสมัครใช้บริการและบัญชีผู้ใช้งาน
- ผู้ใช้บริการต้องให้ข้อมูลที่ถูกต้องและเป็นปัจจุบันในการสมัครใช้งาน
- ผู้ใช้บริการมีหน้าที่รักษาความลับของรหัสผ่านและเปิดใช้การยืนยันตัวตนสองชั้นตามความเหมาะสม
- ผู้ใช้บริการรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของตน
3. ค่าบริการและการชำระเงิน
ค่าบริการเป็นไปตามแพ็กเกจและอัตราที่ประกาศไว้ในหน้าแพ็กเกจราคา ณ ขณะที่สมัครหรือต่ออายุ ผู้ให้บริการอาจปรับอัตราค่าบริการโดยแจ้งล่วงหน้า ตามระยะเวลาที่กำหนดในสัญญาการใช้บริการ การไม่ชำระค่าบริการตามกำหนดอาจทำให้ถูกระงับการใช้งานชั่วคราว
4. ข้อมูลของผู้ใช้บริการ
ข้อมูลที่ผู้ใช้บริการบันทึกในระบบ (ข้อมูลบัญชี เอกสาร ลูกค้า ผู้เดินทาง) ยังคงเป็นกรรมสิทธิ์ของผู้ใช้บริการ ผู้ให้บริการประมวลผลข้อมูลดังกล่าว ในฐานะผู้ประมวลผลข้อมูลส่วนบุคคลตามนโยบายความเป็นส่วนตัวและข้อตกลงประมวลผลข้อมูล (หากมี) ผู้ใช้บริการสามารถส่งออกข้อมูลของตนเองได้ ผ่านฟังก์ชันสำรองข้อมูลของระบบ
5. ข้อจำกัดความรับผิดชอบ
ระบบจัดทำเอกสารและบันทึกบัญชีตามข้อมูลที่ผู้ใช้บริการป้อนเข้าระบบ ผู้ใช้บริการมีหน้าที่ตรวจสอบความถูกต้องของข้อมูลและเอกสารก่อนออกให้ลูกค้า ระบบไม่ใช่บริการให้คำปรึกษาทางบัญชีหรือภาษีอากร และไม่รับประกันว่าเอกสารที่ออกจะถูกต้องตามข้อกำหนดทางกฎหมายทุกกรณีของทุกกิจการ ผู้ใช้บริการควรปรึกษาผู้สอบบัญชีหรือที่ปรึกษาภาษีของตนเอง
6. ความพร้อมใช้งานของระบบ
ผู้ให้บริการจะพยายามดูแลให้ระบบพร้อมใช้งานอย่างต่อเนื่อง แต่ไม่รับประกันว่าจะไม่มีการหยุดชะงัก ไม่ว่าจากการบำรุงรักษาตามแผน เหตุสุดวิสัย หรือเหตุอื่นนอกเหนือการควบคุม
7. การยกเลิกบริการ
ผู้ใช้บริการสามารถยกเลิกการสมัครสมาชิกได้ตามเงื่อนไขของแพ็กเกจที่เลือก ผู้ให้บริการอาจระงับหรือยกเลิกบัญชีที่ละเมิดเงื่อนไขฉบับนี้ หรือใช้งานในลักษณะผิดกฎหมาย เมื่อสิ้นสุดการใช้บริการ ผู้ใช้บริการควรส่งออกข้อมูลของตนเองก่อนบัญชีถูกปิด
8. การแก้ไขเงื่อนไข
ผู้ให้บริการอาจปรับปรุงเงื่อนไขฉบับนี้เป็นครั้งคราว และจะแจ้งการเปลี่ยนแปลงที่มีนัยสำคัญให้ทราบล่วงหน้าตามช่องทางที่เหมาะสม
9. กฎหมายที่ใช้บังคับ
เงื่อนไขฉบับนี้อยู่ภายใต้บังคับกฎหมายไทย

Terms of Service (English)
These terms are an agreement between Patcha Travel Co., Ltd. (registration no. 0135565018187, 555/11 Saransiri Ratchaphruek 346, Bang Duea, Mueang Pathum Thani, Pathum Thani 12000, Thailand) (“Provider”) and the company or individual subscribing to TourAccount (“Subscriber”). Signing up for or using the system constitutes acceptance of these terms.
The service
TourAccount is a double-entry accounting SaaS for tour operators, covering sales documents, bookkeeping, trip costing and related functions per the Subscriber’s chosen plan.
Accounts
The Subscriber must provide accurate, current information, keep credentials confidential, enable two-factor authentication as appropriate, and is responsible for all activity under its account.
Fees
Fees follow the published plan rates at signup or renewal. The Provider may change rates with advance notice as set out in the service agreement. Non-payment may result in suspension.
Subscriber data
Data the Subscriber records in the system remains the Subscriber’s property. The Provider processes it as a data processor under the Privacy Notice and any data processing agreement. Subscribers may export their own data via the system’s backup function.
Disclaimer
The system produces documents and records from data the Subscriber enters; the Subscriber is responsible for checking accuracy before issuing documents to its own customers. This is not accounting or tax advice and does not guarantee legal compliance for every business; Subscribers should consult their own auditor or tax advisor.
Availability
The Provider aims for continuous availability but does not guarantee uninterrupted service, whether due to planned maintenance, force majeure, or other causes outside its control.
Termination
The Subscriber may cancel per its plan’s terms. The Provider may suspend or terminate accounts that breach these terms or applicable law. Subscribers should export their data before an account closes.
Changes
The Provider may update these terms and will give reasonable notice of material changes.
Governing law
These terms are governed by the laws of Thailand.
